Brazil’s presidential election has triggered a new political and legal battle after right-wing candidate Flavio Bolsonaro challenged the result of Sunday’s runoff and announced plans to pursue legal action.

President Luiz Inacio Lula da Silva won the October 25 runoff with 51.79% of the valid vote to Bolsonaro’s 48.21%, according to the figures in the original draft.

The result reversed Bolsonaro’s lead in the first round, when he received 47.03% to Lula’s 45.16%.

A major point of contention was a decision by Supreme Federal Court Justice Cristiano Zanin to extend voting by two hours, keeping polling stations open until 7 p.m. The electoral court paused vote counting during the extension.

Zanin previously served as Lula’s personal lawyer before Lula appointed him to the Supreme Court. That history has fueled concerns among Bolsonaro’s supporters about the appearance of a conflict of interest.

Speaking to supporters in Brasilia on election night, Bolsonaro said his legal team would use the resources available to it and seek to annul the election.

He also alleged that monitors from his Liberal Party were removed from a secure room used during the counting process. No evidence supporting that claim or his broader allegations of irregularities was presented in the reporting described in the original draft.

Bolsonaro argued that the extension disadvantaged voters in areas where polling stations were not reopened. The voting extension and Zanin’s previous relationship with Lula have become focal points for supporters demanding an explanation.

By Monday, Brazilian media reported that Bolsonaro’s legal advisers and political allies had persuaded him to abandon the immediate plan to seek annulment, citing Lula’s margin and the validation of the result by electoral authorities and the Supreme Court.

His team was instead expected to pursue an Electoral Judicial Investigation Action seeking to disqualify Lula’s ticket over alleged abuse of political and economic power during the campaign.

Those allegations would have to be supported with evidence and tested through Brazil’s legal process.

Liberal Party president Valdemar Costa Neto said Monday that the party recognized the election result, a departure from Bolsonaro’s initial election-night position.

Another court decision quickly added to the controversy. Supreme Court Justice Alexandre de Moraes ordered Flavio Bolsonaro to surrender his passports as part of a money-laundering investigation.

The order also barred him from contacting a lawyer identified as Tomaz, who is connected to the investigation. Prosecutors say messages recovered from the lawyer’s phone showed financial ties between the two men.

Bolsonaro called the action intimidation and political persecution. He said he would comply with the order and had no intention of leaving Brazil.

Moraes has played a prominent role in cases involving the Bolsonaro family. He was the lead justice in the trial of former President Jair Bolsonaro, Flavio’s father, who was convicted of attempting to overturn his 2022 election defeat.

The former president was sentenced to 27 years and three months in prison and is serving his sentence under house arrest because of poor health, according to the original draft.

For Bolsonaro’s supporters, the election-day ruling and the passport order have intensified longstanding concerns that Brazil’s judiciary has become too deeply involved in political disputes.

Brazilian voters deserve transparency about the decisions made on election day and a fair hearing for any evidence brought forward. The timing of the decisions alone, however, does not establish election fraud or political persecution.
