House Republicans are moving forward with sweeping legislation designed to make President Trump’s border security gains permanent, ensuring that no future president, Democrat or otherwise, can simply undo years of hard-won progress with the stroke of a pen the way Joe Biden did in 2021.

The bill, formally known as the Permanent Trump Secure Border Act, cleared the House Judiciary Committee last week after more than six hours of markup, and it now awaits a floor vote from the full House. Speaker Mike Johnson is facing pressure from members of his own conference to schedule that vote as quickly as possible.

The legislation is sponsored by Rep. Chip Roy, R-Texas, a longtime border hawk who has pushed for years for Congress to codify enforcement policies into law rather than leaving them vulnerable to executive orders that can be reversed overnight by the next occupant of the White House.

Roy has been blunt about why the bill is necessary. He told colleagues during the markup that daily border encounters have plunged 94 percent since Trump returned to office, and he credited that success directly to policies now aligned with existing law regarding asylum, parole, and catch and release.

His argument is straightforward: those gains must be locked into statute, not left dependent on which party controls the White House.

At the heart of the bill is a major overhaul of the nation’s asylum and parole system, the very mechanisms conservatives say the Biden administration exploited to allow millions of migrants into the country with minimal vetting.

Under current law, immigration officers can approve asylum claims based on only a “significant possibility” that an applicant has a credible fear of persecution. The new bill would raise that bar considerably, requiring officers to find it is “more likely than not” that an applicant is eligible before a claim can proceed.

The legislation would also generally restrict asylum eligibility to migrants who present themselves at legal ports of entry, closing off the incentive for people to cross illegally between ports and then claim asylum after the fact. It further bars asylum claims from migrants who passed through other countries that themselves offer asylum protections, preventing individuals from bypassing safer, closer options in favor of the United States.

Perhaps most significantly for border security advocates, the bill would effectively end catch and release as a matter of federal policy. Under the proposal, most illegal migrants would be required to be detained or promptly returned while their cases are pending, rather than released into the interior of the country to await a court date that, under the Biden administration, could be scheduled years into the future, if it happened at all.

The bill does not stop at asylum reform. It would criminalize visa overstays, a category of unlawful presence that has quietly become one of the largest sources of illegal immigration in the country, often overlooked in favor of headlines about the southern border. It would also increase penalties for unlawful entry more broadly, adding real consequences for repeat offenders.

On the enforcement side, the legislation directs the Department of Homeland Security to modernize border facilities and expand staffing and workforce planning for Customs and Border Protection. It also calls for expanded deployment of surveillance technology at the border, including drones, radar systems, biometric screening, and DNA collection tools designed to help agents verify family relationships and identify repeat crossers using false claims of parentage.

The bill also addresses family detention standards and policies affecting unaccompanied migrant children, areas that were repeatedly exploited during the Biden years by smugglers and cartels who understood that migrants traveling with children, real or fraudulently claimed, were far less likely to be detained or quickly removed.

House Judiciary Chairman Jim Jordan has been direct about the underlying purpose of the bill. According to reporting on the committee process, Jordan said the goal is to make it structurally harder for a future administration to simply reverse these policies the way Biden did upon taking office in 2021, when he suspended border wall construction, halted deportations, and reinstated catch and release within his first days.

That history looms large over this legislative push. Within weeks of Biden’s inauguration, Border Patrol encounters at the southwest border jumped from just over 75,000 in January 2021 to more than 169,000 by March, a level far higher than anything recorded during the entire first Trump administration. Former Biden officials have since acknowledged that his own transition advisers warned him in late 2020 that his approach could trigger exactly this kind of surge, and that the word used internally to describe the risk was “chaos.”

That warning proved accurate almost immediately, and it took four years, hundreds of billions of dollars in strained state and local resources, and a second Trump term to begin reversing the damage. House Republicans argue that the country cannot afford to relearn this lesson every time control of the White House changes hands.

The bill is essentially an updated version of H.R. 2, the border security legislation that passed the House during the previous congressional session but stalled before becoming law. This time, Republicans control both chambers alongside the White House, giving the legislation a far clearer path forward than it had in past years.

Outside groups have already lined up in support. The Federation for American Immigration Reform, known as FAIR, praised the Judiciary Committee’s swift action, with the group’s executive director calling on Speaker Johnson to schedule a floor vote as soon as possible.

FAIR argues the bill systematically closes the very loopholes that allowed what it describes as the largest and most damaging wave of illegal immigration in American history to occur under the Biden administration.

Notably, the push for floor action has not been without friction inside the House Republican conference itself. Conservative members reportedly kept the floor essentially frozen for several weeks in June and July, withholding cooperation on other legislative priorities specifically to pressure leadership into prioritizing this border bill. That internal pressure appears to have paid off, with the bill now cleared for a floor vote.
