The revelation came during an October 2025 hearing before the Minnesota House Fraud Prevention Committee, where Republican lawmakers pressed Linnell on the consequences of Governor Tim Walz’s controversial 2023 “Driver’s Licenses for All” law.
That law allows non-citizens—including illegal immigrants—to obtain standard Minnesota driver’s licenses without providing proof of U.S. citizenship. Critics have long warned this policy could blur the line between citizen and non-citizen identification—and now those concerns appear to be confirmed.

During the hearing, State Rep. Patti Anderson laid out a step-by-step scenario: a non-citizen obtains a driver’s license, registers to vote—potentially through automatic DMV processes—gets flagged for missing or mismatched Social Security information, but still shows up on Election Day with that same license and signs an eligibility affirmation.
Linnell confirmed the loophole.
“If they present the election judge with that acceptable identification document, that would clear the challenge… and they would be permitted to cast a ballot,” he testified.
In other words, the system relies heavily on self-attestation rather than upfront verification—meaning a ballot can be cast before eligibility is fully confirmed.
Minnesota allows same-day voter registration, meaning individuals can register and vote in a single visit with minimal documentation. A driver’s license is sufficient, and voters simply sign a form affirming they are eligible.
While non-citizen voting is a felony under both state and federal law, enforcement largely happens after the vote is cast—if discrepancies are even caught. Critics argue this approach prioritizes access over election integrity, leaving the door open for abuse.
The testimony quickly sparked outrage among conservatives, who say this confirms long-standing concerns about weak safeguards in Democrat-led states.
Reports and viral clips have amplified Linnell’s admission, with many pointing to it as proof that non-citizen voting is not just hypothetical but possible under current law.
Policy analysts have also warned that automatic voter registration through the DMV increases the risk, potentially funneling non-citizens into voter rolls with errors only flagged later—if at all.
Minnesota’s system is now being cited as a warning sign in the broader national debate over election security.
Republicans are pushing for reforms like the SAVE Act, which would require proof of citizenship to register to vote—something Minnesota does not currently mandate at the state level.
Linnell’s testimony makes one thing clear: the pathway exists.
Even if rare, conservatives argue that any system that allows ineligible votes—even one—is unacceptable, especially in close elections where outcomes can be decided by razor-thin margins.
