Louisiana is joining Alabama and Florida in pursuing potential state-level questions involving statements, policies, and possible harm to residents.

The announcement followed Fauci’s appearance before the Senate Homeland Security and Governmental Affairs Committee, where he repeatedly invoked his Fifth Amendment right against self-incrimination. Fauci declined to answer more than 100 questions concerning pandemic policy, the origins of COVID-19, federal research funding, and statements he previously made under oath. Exercising the Fifth Amendment is a constitutional right and does not establish guilt, but the extraordinary number of refusals intensified calls for further investigation.

Fauci served for decades as director of the National Institute of Allergy and Infectious Diseases and became one of the most visible government officials during the pandemic. His recommendations influenced federal guidance involving masks, social distancing, school operations, business restrictions, vaccines, and other policies that affected nearly every American household. Critics have long argued that Fauci exercised enormous authority while giving inconsistent explanations about the scientific basis for some government decisions.

Much of the current dispute centers on Fauci’s prior testimony regarding federally supported coronavirus research and the possibility that COVID-19 emerged from a laboratory. Republican lawmakers have accused him of misleading Congress about whether the National Institutes of Health helped fund research involving altered coronaviruses through EcoHealth Alliance and a laboratory in Wuhan, China. Fauci has repeatedly denied wrongdoing and has maintained that the research did not meet the definition of dangerous gain-of-function work that he used in his testimony. A previous congressional investigation did not establish that Fauci caused the pandemic or committed a crime.

Reactions

Senate Homeland Security and Governmental Affairs Committee Chairman Rand Paul has argued that Fauci’s private records and public statements tell conflicting stories. During the hearing, Paul said, “History will judge, but the facts as we now know them paint a sordid tale of dishonesty, misjudgment and ultimately the hubris, the likes of which the world has never seen.” Paul also indicated that the committee would consider whether to hold Fauci in contempt for refusing to answer its questions.

Fauci rejected the accusations and said the proceeding was intended to trap him into making a statement that could be used in a future prosecution. He said Paul had an “obvious obsession with calling for my prosecution” and explained that he invoked the Fifth Amendment on the advice of his attorney. Fauci’s lawyer, David Schertler, described the proceeding as biased and called the allegations against his client false. Democratic senators also defended Fauci, while a group of infectious-disease specialists said credible evidence of criminal misconduct had not been presented.

Joe Biden issued Fauci a broad federal pardon before leaving office, but a presidential pardon generally applies only to federal offenses and does not automatically prevent states from examining possible violations of their own laws. Louisiana officials must now conduct a careful, evidence-based investigation that respects constitutional rights while following the facts wherever they lead. The goal should not be punishment based on political anger, but a transparent accounting of how extraordinary government power was exercised and whether the public received the truth.
