Florida Governor Ron DeSantis stood firm Tuesday, demanding accountability from a reckless judge whose decision allowed a convicted sex offender to walk free—only for that predator to allegedly murder his own 5-year-old stepdaughter.
The tragedy of little Melissa “Missy” Mogle has ignited outrage across the Sunshine State and beyond, highlighting the dangerous consequences of soft-on-crime judicial activism that prioritizes criminals over innocent lives.
DeSantis, surrounded by Missy’s grieving family members during a solemn bill-signing ceremony in Tampa, did not mince words. He directly called on the Republican-controlled Florida House to impeach Leon County Circuit Judge Tiffany Baker-Carper for her indefensible ruling that kept Daniel Spencer out on bond after his conviction.

“You have the power, and you have sufficient numbers in your chamber, to impeach this judge, Tiffany Baker-Carper,” DeSantis declared, his voice resolute. “Until you start holding these judges accountable, they are going to continue to find ways to benefit the criminal element. This was an outrage.”
The governor’s bold stance reflects a core conservative principle: judges must serve justice, not enable predators. Florida’s Republican supermajority in the House possesses the constitutional authority to act with a two-thirds vote, and many are now urging swift impeachment proceedings.
Missy Mogle, a bright-eyed 5-year-old from Tallahassee, became the victim of unimaginable horror in 2025. Her stepfather, Daniel Spencer, had already been convicted in an underage sex sting operation for attempting to meet a 15-year-old girl for unlawful sexual conduct.
Despite prosecutors urging the court to remand Spencer into custody pending sentencing, Judge Baker-Carper chose leniency. She cited that Spencer had been out on bond for a year without apparent violations and lacked a violent criminal history at that point.
Weeks later, while still free, Spencer allegedly tortured and murdered little Missy—shattering a family and exposing the deadly flaws in a system that too often errs on the side of dangerous offenders.
DeSantis rightly labeled the judge’s decision a “miscarriage of justice” and a “dereliction of judicial duty.” If Missy’s Law had been in place at the time, the governor emphasized, the innocent child would still be alive today.
That is the harsh reality conservatives have warned about for years: when judges ignore public safety in favor of personal discretion or progressive ideologies, vulnerable children pay the ultimate price.
Missy’s Law, formally House Bill 445, closes this deadly loophole once and for all. Effective July 1, 2026, the legislation mandates that judges immediately remand defendants into custody after conviction for specified dangerous crimes, including serious sexual offenses and violent felonies.

DeSantis signed the measure alongside another critical bill, House Bill 1159, which ramps up penalties for child sexual exploitation, creates new offenses for emerging threats like computer-generated abuse material, and strengthens protections for Florida’s most vulnerable.
“These bills ensure that those who victimize children face swift and meaningful consequences,” the governor stated, underscoring Florida’s national leadership in safeguarding families.
Florida Attorney General James Uthmeier echoed the call for impeachment, issuing a strong statement that Judge Baker-Carper’s ruling directly contributed to Missy’s death.
“A convicted child predator was allowed to remain on bond—and now Missy is dead because of it,” Uthmeier declared.
Conservative leaders across the state praised DeSantis for refusing to allow activist judges to undermine public safety. In an era where some blue cities coddle criminals and release repeat offenders, Florida stands as a beacon of common-sense conservatism.
The case exposes a broader pattern: lenient judicial decisions that endanger communities. From sanctuary policies to revolving-door bail systems, liberal approaches have repeatedly failed, leading to preventable tragedies like the one that claimed Missy’s young life.
DeSantis has made judicial accountability a priority throughout his tenure, pushing back against judges who appear more concerned with criminal rights than victim protection. His message to the House was clear—use the tools the state constitution provides.
Impeachment is not taken lightly, but when a judge’s ruling results in the death of a child, accountability is not optional; it is essential to restore faith in the justice system.
Missy’s family, present at the signing, expressed gratitude for the governor’s decisive action. Their pain remains raw, yet they hope Missy’s legacy will prevent future families from enduring similar heartbreak.
Republicans in the Florida Legislature, holding nearly 70 percent of seats in both chambers, are well-positioned to heed DeSantis’ call. Many have already signaled support for reviewing the judge’s conduct and pursuing impeachment if warranted.
Judge Baker-Carper, elected in 2020, now faces intense scrutiny. While she cited Spencer’s prior compliance with bond conditions, critics argue that any convicted sex offender targeting minors poses an inherent risk that should never be underestimated.
