Barbara, centered on his executive order issued on Day One of his second term that seeks to limit automatic birthright citizenship for children born in the United States to parents who are here illegally or on temporary status.

The president’s presence sent a powerful message: this administration will not back down from confronting policies that have turned America into a magnet for illegal immigration and chain migration at the expense of American workers, taxpayers, and national sovereignty.

For decades, conservatives have warned that the broad, modern interpretation of the 14th Amendment’s Citizenship Clause has been twisted far beyond its original intent. That clause was ratified after the Civil War primarily to ensure citizenship for freed slaves – not to grant automatic citizenship to the offspring of millions who enter the country unlawfully or game the system through temporary visas and birth tourism.

President Trump’s executive order aims to restore common sense by directing that citizenship applies only to those born to at least one parent who is a U.S. citizen or lawful permanent resident. This strikes directly at the heart of “anchor baby” incentives that encourage illegal crossings and prolonged illegal stays.

During the arguments, Solicitor General John Sauer vigorously defended the administration’s position, emphasizing that the framers of the 14th Amendment never intended to reward lawbreaking or create a loophole exploited by foreign nationals seeking to secure future immigration benefits for entire families.

Trump’s historic attendance – slipping in shortly before arguments began and remaining for a significant portion before departing – highlights how seriously he takes this issue. No modern president has ever taken such a step, demonstrating his willingness to lead from the front on one of the most critical immigration battles of our time.

The case stems from lower courts blocking the executive order, with activist judges claiming it violates long-standing precedent. Yet conservatives argue that the Supreme Court has never squarely ruled on whether illegal aliens and temporary visitors owe full “allegiance” to the United States in the sense required for their children to claim birthright citizenship under the clause’s “subject to the jurisdiction thereof” language.

As Trump has repeatedly stated, the United States has been “stupid” for allowing this practice to continue unchecked. It drains public resources, incentivizes illegal immigration, and undermines the rule of law. Countries around the world do not automatically grant citizenship this way – why should America be the world’s doormat?

Supporters of the president’s order point to the massive scale of the problem: estimates suggest hundreds of thousands of births each year to illegal aliens, creating long-term costs in education, healthcare, and welfare while facilitating chain migration that brings in extended family members.

Trump’s America First agenda has already delivered historic border security gains in his second term. Attending the Supreme Court arguments reinforces his determination to close every loophole that undermines those efforts.

Even as some justices – including conservatives – probed the administration’s arguments with tough questions, the president’s presence served as a reminder that this fight is about more than legal technicalities. It is about who we are as a nation and whether we will continue to allow our generosity to be abused.

Conservative legal scholars have long contended that the 1898 Wong Kim Ark decision, often cited by opponents, involved a child of legal Chinese immigrants who were domiciled in the U.S. and not in a similar situation to today’s illegal entrants or temporary visa holders who maintain primary allegiance to foreign countries.

By taking the case to the highest court, the Trump administration is forcing a much-needed national reckoning with a policy that no longer serves the interests of the American people in an era of mass global migration and sophisticated exploitation of our laws.

Outside the Supreme Court, protesters on both sides gathered, but inside the chamber, the focus remained on constitutional interpretation and the limits of executive power to clarify longstanding ambiguities in citizenship law.

Trump has made clear that ending the abuse of birthright citizenship is essential to dismantling the entire illegal immigration ecosystem. Without it, the incentives for crossing the border illegally – or overstaying visas – diminish significantly, protecting jobs, schools, hospitals, and communities from overload.
