The original indictment was filed in August 2023 by then‑Fulton County District Attorney Fani Willis, charging Trump and 18 co‑defendants under Georgia’s anti‑racketeering (RICO) law. Among the allegations: attempts to submit a fake slate of electors, pressure on election officials, and other efforts to overturn Georgia’s 2020 results.Shortly after the indictment, cracks appeared. In 2024 defense attorneys revealed that Willis had a romantic relationship with the case’s special prosecutor, creating a conflict of interest. Judge Scott F. McAfee ordered either Willis or the special prosecutor to step down — and when the prosecutor resigned, Willis remained under fire. An appeals court ultimately disqualified Willis from the case, a decision the Georgia Supreme Court left standing in September 2025.

With the indictment stripped of its original prosecutor and no viable replacement willing to take the case, the responsibility fell to Peter Skandalakis. On November 14, 2025, he announced he would assume the role.

Just 12 days later, on November 26, Skandalakis moved to dismiss the case, arguing that pursuing a complex racketeering prosecution — involving a sitting president, multiple co‑defendants, and years of litigation — was no longer “realistic” or in the public interest. A judge gave approval.

In a statement posted on X, Trump’s attorney Steve Sadow called the dismissal a vindication, saying “The political persecution of President Trump by disqualified DA Fani Willis is finally over. This case should never have been brought.”
