Greg Abbott to extradite ICE officer Christian Castro, who faces assault charges in Minnesota stemming from a January immigration enforcement operation. U.S. District Judge Fernando Rodriguez Jr. ruled Minnesota’s request was not “ripe for adjudication,” finding that Abbott “has neither agreed nor refused” to sign the interstate rendition warrant that would send Castro back to Minnesota to face trial.

The ruling came just as a 90-day statutory detention clock for Castro was set to expire under Texas’s Uniform Criminal Extradition Act, the deadline Minnesota had been racing to beat with its federal lawsuit. Minnesota Attorney General Keith Ellison, who brought the case, didn’t back down after the loss, saying “Greg Abbott is turning Texas into a sanctuary state for violent criminals. But regardless of today’s ruling, Christian Castro will not escape justice in Minnesota.”

The case traces back to January 14, 2026, when Castro allegedly fired his weapon through the closed front door of an occupied Minneapolis home during “Operation Metro Surge,” a federal immigration enforcement operation, striking 24-year-old Julio Cesar Sosa-Celis in the leg. Castro reportedly told investigators he acted in self-defense after being attacked with a snow shovel and a broom handle, but surveillance video and witness accounts allegedly contradicted that account, and the Department of Homeland Security itself later investigated him for making “untruthful statements.” Minnesota prosecutors charged Castro in May with four counts of second-degree assault with a deadly weapon and one count of falsely reporting a crime.

Texas Rangers arrested Castro in Cameron County on May 29 on a Hennepin County warrant, and a local judge ordered him held pending extradition. When Abbott didn’t move to sign off within what Minnesota considered a reasonable window, Ellison sued in federal court, arguing Abbott’s inaction “is unconstitutional and violates federal law and Texas law.” Abbott’s office pushed back hard, with the governor saying he has “serious doubts that the prerequisites for extradition have been met” given that Castro was, in the state’s telling, “compelled to return to Texas on orders of the federal government.”

Reactions

Judge Rodriguez sided with Texas on the narrow legal question, writing that neither the Constitution’s Extradition Clause nor the Uniform Criminal Extradition Act sets a specific deadline by which a governor must act, and that Minnesota’s claims “rest on speculation about future events.” He acknowledged the state’s practical concern, writing, “the Court agrees that Castro’s flight to Mexico would impose a hardship on Minnesota’s prosecutorial efforts. But that possible outcome does not alter the analysis.”

Abbott has cast the dispute in broader terms, telling reporters he doesn’t trust Walz “on anything, let alone something like this,” and pivoting to an unrelated grievance of his own: “While they’re making demands, I got a demand of my own and that is: It’s time for Minnesota to step up and repay the United States of America and Americans for all the fraud that they have committed in their state under federal programs.” A spokesman for Abbott, Andrew Mahaleris, added that the Constitution “requires deliberate consideration of extradition requests” and leaves it to the governor to “decide, upon such evidence as he may deem satisfactory,” whether the person demanded is a fugitive.
