Former Lodi City Councilman Shakir Khan was sentenced on March 2, 2026, to three years in San Joaquin County Jail for a multi-count criminal scheme that included voter registration fraud and the fraudulent handling of absentee ballots during his 2020 election victory.
San Joaquin County Superior Court Judge Mallett handed down the sentence after denying Khan’s motion to withdraw his no-contest plea. The court imposed an additional eight-year state prison term that was stayed, meaning it could be enforced if Khan violates the terms of his mandatory supervision. Under Assembly Bill 109, one year of the three-year county jail sentence was suspended and will be served on mandatory supervision.
Khan pleaded no contest in January 2024 to a total of 77 criminal counts, including 14 felony election fraud charges. The remaining counts involved illegal gambling, money laundering, tax evasion, grand theft, and 12 counts of unemployment insurance fraud related to COVID-19 benefits.

The election-related offenses stemmed from Khan’s successful 2020 bid for the Lodi City Council District 4 seat, which he won by a narrow margin of just 282 votes against the incumbent and other opponents.
The case broke open during a separate investigation into illegal gambling. While searching Khan’s home, San Joaquin County Sheriff’s Office deputies discovered 41 sealed and completed mail-in ballots. A citizen review of voter rolls later revealed approximately 70 to 71 voter registrations linked to Khan’s address, phone number, or email address. Prosecutors alleged many of these involved fictitious or unqualified persons.
Investigators determined that Khan had used his personal contact information to register voters, with 23 registrations tied directly to his home address and 47 others linked to his email and phone. Allegations included pressuring individuals — particularly within the local Pakistani community — to vote for him, filling out ballots, and forging signatures.
Khan served on the Lodi City Council from November 2020 until February 2023, when he resigned hours after his arrest on the election fraud charges. He later claimed the resignation was signed under duress during police interrogation and attempted to challenge it, citing body camera footage and a handwritten note.
In addition to the election fraud, Khan faced charges for operating an illegal online gambling business out of the American Smokers Club in Stockton between 2018 and 2020. He admitted to those allegations in a related case and forfeited approximately $77,000 in cash and $383,000 in property assets, which were directed to San Joaquin County’s general fund.
Before the plea deal, Khan faced the possibility of up to 40 years in state prison. The agreement significantly reduced his exposure while still holding him accountable for the serious offenses.
San Joaquin County District Attorney Ron Freitas emphasized the importance of the outcome, stating that the sentence demonstrates the seriousness with which authorities treat attempts to tamper with the electoral process. “Accountability includes honoring the plea and fulfilling the terms of supervision,” he said. “If Mr. Khan fails to comply, the full consequences of his sentence will be enforced.”
This case has been added to the Heritage Foundation Election Fraud Database as an example of fraudulent use of absentee ballots, highlighting vulnerabilities in mail-in voting systems — particularly the risks associated with ballot collection, storage, and handling by third parties rather than voters themselves.
After the sentencing, Khan issued a statement thanking his legal team and expressing respect for the court’s decision. He said he was prepared to “put this chapter behind me and move forward with integrity, focus, and renewed purpose,” while claiming continued dedication to community service.
The sentencing comes amid broader national concerns about election security, especially the expanded use of mail-in ballots. Conservatives have long warned that lax safeguards in states like California make fraud easier to commit and harder to detect, and cases like Khan’s underscore the need for stricter voter ID requirements, limits on ballot harvesting, and rigorous chain-of-custody rules for absentee ballots.
While some on the left downplay such incidents as isolated or “right-wing conspiracies,” the discovery of dozens of completed ballots in a politician’s home — combined with suspicious voter registrations tied to his personal information — reveals real weaknesses that demand stronger protections to ensure only eligible citizens cast legitimate votes.
Khan’s narrow 2020 victory raises legitimate questions about whether the fraud influenced the outcome in that local race. Although he ultimately resigned, the case serves as a cautionary tale about how even small-scale election tampering can erode public trust in democratic institutions.
Supporters of secure elections argue that swift accountability, as shown by the district attorney and the court, is essential to deter future abuses and restore confidence in the voting process.
