U.S. Court of Appeals for the Third Circuit ruled last week that Alina Habba’s service as acting U.S. Attorney for the District of New Jersey was unlawful — disqualifying her from the role.
On Monday, Habba officially resigned. In her statement, she insisted the resignation was meant to preserve “the stability and integrity” of the U.S. Attorney’s Office.
She added: “But do not mistake compliance for surrender. This decision will not weaken the Justice Department and it will not weaken me.”

Habba — formerly a personal lawyer for Donald Trump — was first appointed interim U.S. Attorney for New Jersey in March 2025. 
Under federal law, interim appointments have a 120‑day limit unless the Senate confirms the nominee or a court extends the appointment. When her interim term expired in July, federal district judges moved to install her deputy.
Instead, the administration fired the deputy and reinstalled Habba — first as “special attorney,” then as acting U.S. Attorney — a move the courts later rejected as an unlawful attempt to bypass the Senate confirmation process.

The Third Circuit’s unanimous ruling reaffirmed that those kinds of administrative maneuvers cannot override the requirements of the Federal Vacancies Reform Act (FVRA) and related statutes.

Habba slammed the court’s ruling as politically motivated, but framed her resignation as a necessary move to avoid further instability in the office.
